{"id":145,"date":"2021-09-09T15:46:10","date_gmt":"2021-09-09T13:46:10","guid":{"rendered":"https:\/\/opl245papers.quivi.it\/?post_type=storie&#038;p=145"},"modified":"2021-12-09T14:02:04","modified_gmt":"2021-12-09T13:02:04","slug":"milan-judges-adoke-received-a-benefit","status":"publish","type":"storie","link":"https:\/\/opl245papers.org\/en\/storie\/milan-judges-adoke-received-a-benefit\/","title":{"rendered":"Milan Judges: Adoke received \u201ca benefit\u201d from OPL 245 funds"},"content":{"rendered":"\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/opl245papers.org\/en\/wp-content\/uploads\/2021\/12\/opl-milan-1024x576.jpg\" alt=\"\" class=\"wp-image-315\" srcset=\"https:\/\/opl245papers.org\/en\/wp-content\/uploads\/2021\/12\/opl-milan-1024x576.jpg 1024w, https:\/\/opl245papers.org\/en\/wp-content\/uploads\/2021\/12\/opl-milan-300x169.jpg 300w, https:\/\/opl245papers.org\/en\/wp-content\/uploads\/2021\/12\/opl-milan-768x432.jpg 768w, https:\/\/opl245papers.org\/en\/wp-content\/uploads\/2021\/12\/opl-milan-1536x864.jpg 1536w, https:\/\/opl245papers.org\/en\/wp-content\/uploads\/2021\/12\/opl-milan.jpg 1920w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n<section>\n            <div class=\"lg:text-36 text-30 texgyreheros-cn-regular uppercase\"><p>Mortgage with Unity Bank was repaid via OPL 245-derived cash payments from Bureaux de Change<\/p>\n<\/div>\n    <\/section>\n\n<section>\n            <div class=\"underline-a lg:text-22 text-19\"><p><span style=\"font-weight: 400;\">In their judgment acquitting Shell, Eni and other defendants of international corruption in the OPL 245 deal, the Milan judges ruled that Nigeria\u2019s former Attorney General, Mohammed Bello Adoke SAN, received some $2 million as \u201ca benefit\u201d from the transaction.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><a href=\"https:\/\/www.eni.com\/assets\/documents\/documents-en\/opl-245-full-decision.pdf\"><span style=\"font-weight: 400;\">According to the judges<\/span><\/a><span style=\"font-weight: 400;\">, the money originated from Nigerian entrepreneur Aliyu Abubakar and was deposited into Adoke\u2019s mortgage account with Unity bank via numerous cash payments from Bureaux de Change.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Adoke, who was not on trial in Milan, negotiated the final agreements under which Shell and Eni agreed to pay some $1.1 billion to Malabu through the Federal Government of Nigeria for the huge offshore oil field.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Describing Adoke as \u201c<\/span><span style=\"font-weight: 400;\">the mover and promoter of the reconfirmation of the license awarded to Malabu\u201d,<\/span><span style=\"font-weight: 400;\"> the Milan court ruled as a fact that he is \u201c<\/span><span style=\"font-weight: 400;\">the only one of the three public officials named in the indictment as necessary parties of the corrupt arrangement to have received a benefit deriving directly from the funds coming from the OPL 245 transaction<\/span><span style=\"font-weight: 400;\">\u201d.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">More specifically, the judges state: \u201cIn fact, it has been revealed that Adoke Bello received a property at a below-market price through a company managed by the straw man Abubakar, who had previously purchased the land with a loan paid for with cash coming from the bureaux de change where the funds for the compensation received by Malabu and entrusted to Abubakar for management had been monetised. In this regard, the Court agrees on the reconstruction of the facts made by the prosecution, because it pertains to the acquired information\u201d.<\/span><\/p>\n<\/div>\n    <\/section>\n\n<section>\n            <div class=\"lg:text-36 text-30 texgyreheros-cn-regular uppercase\"><p>Payment for Legal Services to Etete?<\/p>\n<\/div>\n    <\/section>\n\n<section>\n            <div class=\"underline-a lg:text-22 text-19\"><p><span style=\"font-weight: 400;\">The judges hypothesise that the benefit received by Adoke may have constituted a perfectly legal payment for legal services provided by the former Attorney General to Dan Etete, the principal of Malabu, when Adoke was in private practice.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">However, the judges\u2019 hypothesis conflicts with statements made by Adoke through his lawyers. Adoke\u2019s London solicitors Gromyko Amedu have stated: \u201cOur client has never acted as counsel to Chief Dan Etete and the two have never had a client\/solicitor relationship\u201d. The lawyers have also stated that Adoke vigorously denies receiving <\/span><i><span style=\"font-weight: 400;\">any<\/span><\/i><span style=\"font-weight: 400;\"> benefit from OPL 245.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Adoke, who is on trial in Nigeria along with Abubakar for <\/span><a href=\"https:\/\/shellandenitrial.org\/wp-content\/uploads\/2018\/08\/2-Adoke-etc-Nigeria-charges-scanned-2.pdf\"><span style=\"font-weight: 400;\">OPL 245-related corruption offences<\/span><\/a><span style=\"font-weight: 400;\">, does not dispute that he took out a mortgage to purchase a house from Abubakar, or that Abubakar repaid the loan when Adoke was unable to service the mortgage. Both he and Abubakar deny any wrongdoing.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">In his autobiography titled <\/span><i><span style=\"font-weight: 400;\">Burden of Service<\/span><\/i><span style=\"font-weight: 400;\">, Adoke explains that Abubakar, described by Adoke as \u201ca builder and a developer whom I had been acquainted with for a long time\u201d, offered to sell him a house for N500 million<\/span> <span style=\"font-weight: 400;\">(equivalent to \u20ac2.425 Million euros at the time). The price being beyond what he could afford from his salary, Adoke sought and obtained a mortgage of N300 million from Unity Bank.\u00a0 According to Adoke, the payment was \u201cmade directly to the developer, not me\u201d.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Adoke states that he later found himself unable to service the mortgage, causing the Central Bank of Nigeria (CBN) to take an interest in the loan as Adoke was a Politically Exposed Person. When Abubakar \u201cgot wind of the interest of the CBN in the property\u201d, he \u201cwanted to take it back\u201d. He contacted Adoke \u201coffering to return the money paid to him by the bank\u201d. Adoke then suggested Abubakar \u201cshould approach the bank and offer to pay back the loan\u201d. Adoke also asked Abubakar \u201cto retrieve the title documents which he gave to the bank upon receipt of their N300 million\u201d.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Adoke says he does not know for sure what happened next. He writes: &#8220;I have no inkling of how [Abubakar] paid or how much he paid. I have no idea if he made the payment in dollars, neither do I know if a bureau de change was involved. I merely recall that both the developer and the MD of the bank confirmed to me that the loan had been repaid and that the title documents had been returned. I asked that the bank account be closed. That ended the matter as far as I was concerned.&#8221;<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Adoke\u2019s London solicitors have stated that, having paid off the mortgage and obtained the registration documents, Abubakar subsequently sold the property to the Central Bank of Nigeria.<\/span> <a href=\"https:\/\/www.thisdaylive.com\/index.php\/2020\/05\/18\/opl-245-how-italian-prosecutors-hid-vital-information-from-judge\/\"><span style=\"font-weight: 400;\">This Day Live<\/span><\/a> <span style=\"font-weight: 400;\">reports that the house has been the property of the CBN since 2013.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Adoke denies that he has ever taken a bribe: \u201cI did not collect any bribe from anybody for the five years that I was a Minister. I repeat: I never took a kobo, a cent or a dollar bribe from anybody throughout my tenure as Minister\u201d.<\/span><\/p>\n<\/div>\n    <\/section>\n\n<section>\n            <div class=\"lg:text-36 text-30 texgyreheros-cn-regular uppercase\"><p>The Milan Evidence: Red flags<\/p>\n<\/div>\n    <\/section>\n\n<section>\n            <div class=\"underline-a lg:text-22 text-19\"><p><span style=\"font-weight: 400;\">Documents accepted as evidence by the Milan Court confirm that <\/span><span style=\"font-weight: 400;\">Aliyu Abubakar offered to sell Adoke<\/span><span style=\"font-weight: 400;\"> a property described as \u201cPlot 3271, Cadastral Zone A06, Maitama, Abuja&#8221; for 500 million naira. The offer letter, which was sent on 5 October 2011, was made by Carlin International, a company owned by Abubakar. It was signed by Bashir Adewuni as \u201cproperty manager\u201d for Carlin International.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">The court documents also confirm that, on 29 December 2011, <\/span><span style=\"font-weight: 400;\">Adoke applied to Unity Bank<\/span><span style=\"font-weight: 400;\"> on for a mortgage of N300 million to purchase \u201ca house on Vanetta Street, off Maitama\u201d. The mortgage was approved on 7 February 2012.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">However, the evidence presented to the Milan court files raise a number of red flags over the mortgage transaction:<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">In <\/span><a href=\"https:\/\/www.radioradicale.it\/scheda\/561838\/processo-scaroni-ed-altri-presunte-tangenti-pagate-da-eni-in-nigeria\"><span style=\"font-weight: 400;\">sworn evidence<\/span><\/a><span style=\"font-weight: 400;\"> to the Milan Court, Bashir Adewuni testified that he <\/span><span style=\"font-weight: 400;\">was not aware<\/span><span style=\"font-weight: 400;\"> of any sale of a property from Carlin to Adoke and that he did not know and had never met Adoke. When shown a Carlin Document which named him as the Property Manager, he claimed the signature was not his.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Whereas Adoke asserts that the mortgage payment was \u201cmade directly to the developer, not me\u201d, Unity Bank documents record that the money paid to the developer came from Adoke\u2019s account. A bank slip records that the payment was made \u201cby order of Mr Mohammed Bello Adoke\u201d.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">A <\/span><span style=\"font-weight: 400;\">legal search<\/span><span style=\"font-weight: 400;\"> conducted by Brenda Oluwade and Associates on behalf of Unity Bank records that the land was not registered to Carlin at the time that Adoke paid the company for the property. The registered owner was another company, City Hopper Properties and Investment Company Limited.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">In his application for the mortgage loan, Adoke affirms that he had already advanced N200 million in equity to the vendor. An internal Unity Bank memo also states that an \u201cequity contribution of the sum of N200 million was already advanced to the vendor (Carlin International Limited)\u201d and that proof had been received by the Bank&#8217;s Credit Administration Department. However, in subsequent <\/span><a href=\"https:\/\/www.thecable.ng\/adoke-how-desperate-efcc-framed-me-up-over-malabu\"><span style=\"font-weight: 400;\">press interviews<\/span><\/a><span style=\"font-weight: 400;\"> and his autobiography, Adoke states that he was unable to raise the N200 million: \u201cI had hoped to raise the N200 million from the sale of a piece of land I owned in Abuja. However, it turned out that I could not secure a buyer for that price.\u201d<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">The loan was approved by Unity Bank without any precise details of the property being purchased: the property is described as a &#8220;house at Venetta Street, Maitama, Abuja&#8221; \u2013 no plot number or house number is given \u2013 despite the property being the collateral for the loan.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Although internal Unity Bank memos initially state that all the necessary documentation for the loan had been obtained, bank staff later warn that the account had \u201cnot been regularised\u201d and that \u201cwe do not have any document to support the facility as contained in the conveyance letter\u201d.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Although Adoke states that he was unaware how the mortgage loan was repaid or whether a bureau de change was involved, his bank statements clearly record numerous cash payments from bureaux de change. In just one day, 8 October 2012, 30 separate deposits of 1 million naira in cash were paid into the account. The deposits were all under the ceiling that would trigger money laundering inquiries.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">The Milan case file does not contain any record in the documentation from Unity Bank of any deeds being \u201creturned\u201d to Abubakar or of the Central Bank of Nigeria making inquiries about the loan.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Although Adoke\u2019s lawyers have stated that the property was sold by Abubakar to the Central Bank of Nigeria, the Abuja Geographic Information System confirmed to the\u00a0 Economic and Financial Crimes Commission in 2106 that the property was still registered to City Hoppers under a Certificate of Occupancy that had been in place since 1995.<\/span><\/p>\n<\/div>\n    <\/section>","protected":false},"excerpt":{"rendered":"","protected":false},"featured_media":0,"template":"","class_list":["post-145","storie","type-storie","status-publish","hentry"],"_links":{"self":[{"href":"https:\/\/opl245papers.org\/en\/wp-json\/wp\/v2\/storie\/145","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/opl245papers.org\/en\/wp-json\/wp\/v2\/storie"}],"about":[{"href":"https:\/\/opl245papers.org\/en\/wp-json\/wp\/v2\/types\/storie"}],"wp:attachment":[{"href":"https:\/\/opl245papers.org\/en\/wp-json\/wp\/v2\/media?parent=145"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
