Allegations of judicial malpractice and the Milan trial"},"content":{"rendered":"<section>\n            <div class=\"underline-a lg:text-22 text-19\"><p><span style=\"font-weight: 400;\">In March 2021, after a 3-year trial, the Milan Court of First Instance <\/span><a href=\"https:\/\/www.eni.com\/assets\/documents\/documents-en\/opl-245-full-decision.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">acquitted<\/span><\/a><span style=\"font-weight: 400;\"> Shell, Eni and 11 other defendants of international corruption in the acquisition of the OPL 245 oil field in Nigeria.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">The judges held that the prosecution had failed to prove its case that over $1 billion had been paid in bribes to Nigerian government officials and politicians to acquire the license for the field, one of the largest in Africa.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Since the acquittal, however, the Italian press has been awash with allegations that, if upheld, cast grave doubts on the integrity of the judgment.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Concerns over the probity of the trail first surfaced in February 2020 when the Milan Prosecutor sought to admit a statement by Piero Amara, a former external lawyer for a number of Eni\u2019s managers, that Eni had conducted surveillance of the prosecutors, key witnesses and the judges in order to discredit witnesses or gain an advantage in the proceedings. The full transcript of Amara&#8217;s statement was not made public &#8211; large parts were blacked out &#8211; and the judges refused to admit the evidence.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Two days after the judgment, the Italian newspaper <\/span><a href=\"https:\/\/www.ilriformista.it\/dietro-la-sentenza-su-eni-ce-la-guerra-tra-le-correnti-in-magistratura-204639\/\" target=\"_blank\" rel=\"noopener\"><i><span style=\"font-weight: 400;\">Il Riformista<\/span><\/i><\/a> <span style=\"font-weight: 400;\">reported that Amara had also alleged that Eni&#8217;s lawyers had &#8220;preferential&#8221; access to OPL 245 judges. This is denied by Eni, which has an ongoing case against Amara for defamation.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">According to <\/span><i><span style=\"font-weight: 400;\">Il Riformista<\/span><\/i><span style=\"font-weight: 400;\">, Amara told investigators from the Milan prosecutors\u2019 office that two Eni lawyers, Michele Bianco and Alessandra Geraci, as well as two attorneys acting for Eni in the Milan trail \u201chad access\u201d to Presiding Judge Tremolada.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">The allegations were passed to the authorities in Brescia, who are responsible for investigating allegations against the Milan judiciary. <\/span><i><span style=\"font-weight: 400;\">Il Riformista<\/span><\/i><span style=\"font-weight: 400;\"> reports that both Bianco<\/span> <span style=\"font-weight: 400;\">and<\/span> <span style=\"font-weight: 400;\">Geraci denied Amara\u2019s allegations. The investigation was closed without charges being bought. The Milan prosecutors are still investigating Amara and his network inside Eni.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Other allegations have followed. The Italian press has reported that the lawyer of Eni\u2019s CEO and senior judges belonged to an alleged Masonic Lodge. The secret group is currently under investigation in Brescia and Perugia to assess whether the accusation are concrete and whether the Lodge was able to influence the nomination of judges and prosecutors in Italy.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In response to <\/span><a href=\"https:\/\/www.ilfattoquotidiano.it\/2021\/07\/26\/caso-eni-nigeria-al-csm-cominciano-le-audizioni-sentito-il-giudice-tremolada\/6274735\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Amara\u2019s claims<\/span><\/a><span style=\"font-weight: 400;\"> that the integrity of the Milan judges was in doubt, the Head of the Milan Prosecutors Office, Francesco Greco, issued a statement on 24 March 2021, confirming that the Milan Prosecutors in the case, Fabio de Pasquale and Sergio Spadaro, had been subject to \u00abintimidation\u00bb.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Greco\u2019s statement also confirmed that there had been attempts to \u00abdelegitimise the Milan prosecutor\u00bb. However since the Opl 245 verdict in March 2021, the tensions among the Milan prosecutors have erupted into an open confrontation. One of the prosecutor investigating Piero Amara, Paolo Storari, accused his colleagues and his superiors of obstructing the course of justice against Amara. Storari claimed his colleagues Fabio De Pasquale and Sergio Spadaro failed to disclose important evidence to the Milan OPL 245 trial that is said to exonerate Eni\u2019s managers.<\/span><\/p>\n<\/div>\n    <\/section>\n\n\n<figure class=\"wp-block-image size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/opl245papers.org\/en\/wp-content\/uploads\/2021\/10\/fotogramma-amara-armanna-edit-1024x803.jpg\" alt=\"\" class=\"wp-image-246\" width=\"840\" height=\"658\" srcset=\"https:\/\/opl245papers.org\/en\/wp-content\/uploads\/2021\/10\/fotogramma-amara-armanna-edit-1024x803.jpg 1024w, https:\/\/opl245papers.org\/en\/wp-content\/uploads\/2021\/10\/fotogramma-amara-armanna-edit-300x235.jpg 300w, https:\/\/opl245papers.org\/en\/wp-content\/uploads\/2021\/10\/fotogramma-amara-armanna-edit-768x602.jpg 768w, https:\/\/opl245papers.org\/en\/wp-content\/uploads\/2021\/10\/fotogramma-amara-armanna-edit-1536x1204.jpg 1536w, https:\/\/opl245papers.org\/en\/wp-content\/uploads\/2021\/10\/fotogramma-amara-armanna-edit.jpg 1920w\" sizes=\"auto, (max-width: 840px) 100vw, 840px\" \/><figcaption>A frame of the video taken by a hidden camera on 28 July 2014 at the offices of the company STI Spa in Rome.&nbsp;In the frame you see Piero Amara, from behind, and Vincenzo Armanna, in front of him.<\/figcaption><\/figure>\n\n\n<section>\n            <div class=\"underline-a lg:text-22 text-19\"><p><span style=\"font-weight: 400;\">The Head of Milan\u2019s judges, Roberto Bichi, has also confirmed in a statement dated 29th March, two weeks after the Oil 245 verdict, that \u00aba recent significant trial [was] completed despite ascertained attempts of external influence\u00bb.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Those attempts centred on the activities of Amara and a former prosecutor Giancarlo Longo, a magistrate in Siracusa, Sicily, who were found guilty in 2020 of conspiring to \u201cpollute\u201d several investigations, including the OPL 245 investigation carried out by the Milan Prosecutor. Amara is currently in jail.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Amara was accused of bribing Longo to set up a fake investigation into critics of ENI CEO Claudio Descalzi with the aim of protecting Descalzi.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">The complaint which triggered the fake investigation was submitted anonymously to Longo but the investigation disclosed it was submitted by an energy trader close to Amara. The anonymous document also accused Bruno Cova (one of Shell&#8217;s lawyers in the OPL 245 trial) and Luca Santa Maria (one of the lawyers who defended Eni manager Vincenzo Armanna) of being the contacts for \u00abmembers of the Nigerian secret services who would have been responsible for sending to the members of the Board of Directors of ENI S.p.A. (and not only to them), a list of the names of the members of the Board of Directors of ENI S.p.A., anonymous e-mails containing slanderous hypotheses against Claudio Descalzi\u00bb.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">The fake conspiracy was blown apart when Amara and Longo were themselves investigated by magistrates from Messina, Rome and Milan.\u00a0 When interviewed, Amara stated that he had been informed that Eni \u00abcarried out an information-gathering activity in respect of members of the Board of Directors aimed at acquiring useful information in order to discredit people.\u00bb<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">According to Amara, information was also acquired \u00abon those who could have headed the judicial panels of the OPL245 trial.\u00bb<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><a href=\"https:\/\/www.ansa.it\/english\/news\/general_news\/2018\/02\/06\/police-search-eni-office-over-false-plot-4_5a9be2fa-89c6-468c-b925-6c9be98fca4e.html\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Eni\u2019s former legal counsel<\/span><\/a><span style=\"font-weight: 400;\">, Massimo Mantovani, is reported to have been suspected by the police of aiding and abetting Amara. Mantovani denies the allegation.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">During the OPL 245 trial, the Prosecutor also alleged that Descalzi personally attempted \u201cto pollute\u201d the proceedings by allegedly sending a senior Eni manager to bribe former Eni manager Vincenzo Armanna to withdraw allegations against Descalzi. Armanna confirmed these allegations in the Milan court.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Eni and Descalzi have denied any wrongdoing in the Siracusa scandal and, in 2019, attempted to sue Amara and Armanna for defamation.<\/span><\/p>\n<\/div>\n    <\/section>","protected":false},"excerpt":{"rendered":"","protected":false},"featured_media":0,"template":"","class_list":["post-147","storie","type-storie","status-publish","hentry"],"_links":{"self":[{"href":"https:\/\/opl245papers.org\/en\/wp-json\/wp\/v2\/storie\/147","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/opl245papers.org\/en\/wp-json\/wp\/v2\/storie"}],"about":[{"href":"https:\/\/opl245papers.org\/en\/wp-json\/wp\/v2\/types\/storie"}],"wp:attachment":[{"href":"https:\/\/opl245papers.org\/en\/wp-json\/wp\/v2\/media?parent=147"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
